Abstract Recent legislation in Brazil has fully integrated and codified regulatory impact assessment (RIA). This institutional change was introduced to cope with deficiencies and to reduce regulatory burden in the economy. Based on the literature review, one of the merits of RIA is its ability to maximize good governance. Indeed, researchers argue that the adoption of a mandatory RIA in Brazil can be understood in view of “agencification”, and that a top-down RIA is a key mechanism to overcome a legal gap in rulemaking and improve both the legitimacy and coherence of public regulation.
