Abstract Directive 2014/89/EU of the European Parliament and of the Council establishing a framework for maritime spatial planning, adopted on the July 23, 2014, imposes on the coastal EU Member States an obligation to develop spatial development plans of marine areas, in conformity with the objectives and guidelines set therein. March 31, 2021 is the deadline for the directive implementation, however States were expected to adopt the laws, regulations and administrative provisions necessary to develop the plans by September 18, 2016. This paper presents the Polish legislation concerning maritime spatial planning and is also an attempt to asses the solutions adopted so far by the Polish legislator as well as indicate possible consequences of the taken legislative decisions, taking into account the whole legal system and the possibility of judicial review of adopted spatial development plans of sea areas.
