A medical practitioners tribunal erred in deciding only to suspend a doctor convicted of gross negligence manslaughter from the UK medical register rather than strike her off, the General Medical Council has said in the High Court.1 Ivan Hare QC, for the GMC, said that the tribunal impermissibly went behind the findings of the Crown Court jury that in November 2015 found Hadiza Bawa-Garba guilty of the manslaughter of 6 year old Jack Adcock.2 The tribunal took account of “multiple systemic failures” at Leicester Royal Infirmary on the day in February 2011 when Jack, who had Down’s syndrome, was admitted with shallow breathing and dehydration caused by vomiting and diarrhoea.
